1. Introduction; Agreement to These Terms

These Terms of Service (the “Terms”) are a binding contract between you (“you” or “User”) and Refare (“Refare,” “we,” “us,” or “our”). These Terms govern your access to and use of https://www.refare.com and any related products or services we provide (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

2. Changes to These Terms

We may update these Terms from time to time, including to reflect changes to the Service, legal requirements, or our business practices. When we do, we will update the “Effective Date” above. If changes are material, we may provide additional notice (for example, by posting a notice on the website or within the Service).

By continuing to use the Service after updated Terms become effective, you agree to the updated Terms.

3. Account Registration and Security

You may need to create an account or connect accounts (such as loyalty or frequent flyer accounts) to use certain features of the Service. You are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • Restricting access to your account and devices; and

  • All activity that occurs under your account, whether or not authorized by you.

You agree to notify us promptly if you suspect any unauthorized use of your account or any security breach.

4. Agency; Limited Power of Attorney (Authorization to Act)

To provide the Service (including monitoring fares, communicating with airlines, and requesting or negotiating refunds, credits, or other fare adjustments), you authorize Refare to act on your behalf as your agent and attorney-in-fact solely for the limited purpose of interacting with airlines and related travel providers regarding your eligible bookings.

This authorization includes the authority to (as applicable): communicate with airlines; submit requests, disputes, or claims; accept or decline offers; and request, obtain, and facilitate the issuance of refunds, credits, vouchers, or other fare-related adjustments that are due to you under applicable airline rules.

You represent that you have the right to grant this authorization (including for any booking you submit) and that the information you provide is accurate and complete. You may revoke this authorization by contacting us; however, revocation may prevent us from completing ongoing work related to your bookings.

5. Non-Affiliation & Trademark Disclaimer (Nominative Fair Use)

Refare is an independent entity and is not affiliated, associated, authorized, endorsed by, or in any way officially connected with any airline referenced on the Service, including but not limited to Alaska Airlines, American Airlines, Delta Air Lines, Emirates, KLM Royal Dutch Airlines, Lufthansa, Spirit Airlines, Southwest Airlines, and United Airlines (collectively, “Airlines”). Any references to Airlines are for identification and reference purposes only.

All airline names, logos, trademarks, service marks, and trade names displayed on or referenced by the Service are the property of their respective owners. Use of such marks is intended to constitute nominative fair use where applicable, solely to identify the airlines and services with which the Service may interact on your behalf. Nothing in these Terms or on the Service should be interpreted as implying any partnership, joint venture, sponsorship, endorsement, or other relationship between Refare and any airline.

6. Fees; Payment; Savings Share

Refare charges a fee based on a percentage of the value of the savings we obtain for you through the Service (for example, where an airline issues a refund, credit, voucher, or other adjustment due to a price drop or applicable fare rules). The percentage, how savings are calculated, and any other billing details will be disclosed to you in the Service or at the time you enroll, and you authorize Refare to collect such fees as described at the time of purchase or enrollment.

Savings outcomes depend on airline rules, fare conditions, and eligibility requirements set by airlines and may change without notice.

7. Arbitration Agreement; Class Action Waiver

You and Refare agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration, rather than in court, except that either party may bring a claim in small claims court if it qualifies.

You and Refare also agree that disputes will be arbitrated only on an individual basis and not on a class, collective, consolidated, or representative basis. There is no right or authority for any dispute to be brought, heard, or arbitrated as a class action or in a purported representative capacity.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REFARE DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, REFARE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY PARTICULAR SAVINGS, REFUND, CREDIT, OR OUTCOME WILL BE ACHIEVED. AIRLINE PRICES, POLICIES, ELIGIBILITY, AND RESULTS ARE DETERMINED BY AIRLINES AND MAY CHANGE WITHOUT NOTICE.

9. Refare Fairness & Transparency Guarantee

  1. No Upfront Costs: Refare does not charge any sign-up fees, membership fees, or subscription costs. Our service is provided to you at no initial cost.

  2. Success-Based Service: You will only be charged a fee when Refare successfully secures a refund or savings on your flight booking. If we don’t save you money, you don’t pay us.

  3. No Credit Card Required for Entry: We do not require credit card information to begin monitoring your flights. Payment information is only requested when a successful saving is achieved.

  4. Transparent Fee Structure: Our success fee is clearly stated and will never be hidden behind "bait-and-switch" tactics.

  5. 30-Day Notice of Changes: Should Refare decide to modify its fee structure or introduce new pricing models, we commit to providing all active users with at least 30 days' notice via email prior to any changes taking effect.

This guarantee is our commitment to staying the most transparent partner in your travel savings journey.
1. The "$0 Upfront" Commitment
Refare hereby warrants that the initiation of its fare-monitoring services—including the use of the Refare AI Agent to track price fluctuations—shall require no upfront payment, no subscription sign-up fee, and no recurring annual or monthly charges.
2. No Credit Card Requirement for Activation
Users may activate the Refare service and begin monitoring flight itineraries without providing credit card information or any other payment method. Payment information shall only be requested at the time a "Realized Saving" (as defined in Section 4) is identified and the User elects to proceed with the refund or credit process.
3. Success-As-A-Service Model
Refare operates strictly on a contingency-fee basis. Our fee is calculated solely as a percentage of the actual savings secured for the User.

  • No Savings, No Fee: If Refare does not secure a lower fare or a refund for the User, the User owes Refare nothing.

  • Cap on Fees: Under no circumstances shall Refare charge a fee that exceeds the total amount of the refund or credit secured for the User.

4. Definition of Realized Savings
"Realized Savings" is defined as the net difference between the original fare paid by the User and the new, lower fare secured by Refare (inclusive of taxes and carrier-imposed fees). Refare guarantees that the calculation of savings is based on verifiable airline price data at the time of the "Refaring™" event.
5. Protection Against Hidden Charges
Refare prohibits the use of "bait-and-switch" pricing. Specifically:

  • No Hidden Processing Fees: There are no administrative fees, data-processing fees, or "AI maintenance" fees.

  • Complete Fee Disclosure: The exact percentage of the success fee will be displayed clearly to the User prior to the finalization of any rebooking or refund claim.

6. Transparency and Notice of Fee Adjustments
Refare values the trust of its Users. In the event that Refare modifies its fee percentage or introduces new optional paid features:
30-Day Notice: Existing Users shall receive no less than thirty (30) days' notice via the email address associated with their account.
Legacy Protection: Any itineraries currently being tracked at the time of a fee change will be honored at the original rate effective at the time the tracking began.
7. Non-Affiliation and Independence
As stated in our Non-Affiliation Disclaimer, Refare operates independently of the airlines. Our transparency guarantee extends to our negotiations; we work solely on behalf of the User to ensure the maximum possible refund is returned to the User’s original payment method or frequent flyer account.
8. Conflict of Terms
In the event of a conflict between the terms of this Guarantee and the general Refare Terms of Service, the terms of this Guarantee shall prevail regarding fee structures and transparency obligations.

By using Refare, you acknowledge that you have read and understand this Guarantee. We are committed to eliminating the frustration of overpaying for travel through total pricing integrity.
